On appeal from the Court of Appeal for Quebec, [2011] J.Q. no 9469.
Civil procedure -- Appeal -- Security for costs -- Robinson and Productions Nilem asked the Court to order Cinar and the other applicants to provide security in the amount of $3,250,000 for the amounts they would have to pay should their appeals be unsuccessful -- Although it was not be impossible that such security, whether the deposit of a bond or any other form of security, be ordered in excess of $500, it had never been granted as a condition for bringing an appeal -- It was difficult to reconcile security such as this with the requirements underlying proper access to the Supreme Court, the procedure for granting leave to appeal being in itself a sufficient deterrent against frivolous or dilatory appeals -- Motion dismissed -- Supreme Court Act, s. 60(1)(b).
